TERMS

MercyWallet is a service provided by Catholicer. App or Apps refer to the MercyWallet mobile app. Dashboard or dashboards refer to MercyWallet website available at www.mercywallet.com/admin. Service or services refer to all MercyWallet technology. Recipients refers to 501(c)(3) that will receive the donation. Donor refers to a user in MercyWallet App.

CATHOLICER ACCOUNT

Accessing this app requires a Catholicer Account via the Catholicer Single-Sign-On (SSO) service. Catholicer Account is an account across Catholicer platforms. Your Catholicer account comes with a public profile page generated during the registration process. MercyWallet may use & update basic information, contact, location, and a few other necessary information for MercyWallet to function properly. You are responsible to keep the account safe, updated and complete. Failure to do so is considered a breach of terms and conditions and MercyWallet may terminate your account at any time. Altering Catholicer account or its profile from any services you used Catholicer SSO to sign-in is meant to simplify your life. However, any vulnerabilities, mistakes or damages done by those services are beyond MercyWallet control.

ACCOUNT DELETION

You can ask for MercyWallet account deletion to remove your general profile, payment methods, and personal identifiable information. However, this action does not alter or delete your Catholicer account. It is your responsibility to ensure your Catholicer account is up-to-date or deleted separately after deletion of MercyWallet usage. By deleting your data, all prior donations will effectively stored as annonymous donations, and you will no longer have access or receive any tax-related receipts.

DONOR

A donor can be one of the following: 1. an individual person with a unique Catholicer Account under his/her name. 2. an organization with a unique Catholicer Account under the organization name. Using an individual account to represent an organization is a breach of this terms and conditions.

SHARING INFORMATION

MercyWallet exposes the following personal donor information to claimed recipients. Name, email, address (if available), and all transactions made to the recipient. Recipients are welcome to contact these individuals to ask them to opt-in for future solicitations. Personal information must be kept secure at all time and may not be shared to other parties without the donor's consent. Please check our Privacy Statement.

TRANSACTIONS

Transactions may occur in two forms.

All transactions, activities, and failures in payment gateway are beyond Catholicer's control. Cancellation and refund are generally not allowed but may be considered in some cases at Catholicer's discretion. Receiving organizations may not use MercyWallet to render any goods or services in exchange for the donation received on purpose.

NONPROFIT VALIDITY

Catholicer is not responsible for any fraud, failure, crime, or any kinds of irresponsible actions conducted by donation recipients. MercyWallet tries its best to show correct information about all nonprofits listed in our services, however, user should not use provided information as a decisive factor to proclaim the validity of any listed nonprofits. Some nonprofits might have been silently dissolved, revoked, halted, paused, altered, merged, or reincorporated with a different EIN or name. MercyWallet may let nonprofits receive any donations from our services regardless the situations around its legal or tax status. MercyWallet users are encouraged to the legal condition of the recipient before making any donations. We cannot refund any donations that have arrived to a wrong destination due to any circumstances caused by the recipient's side, unless the receipient agreed to return the donation in full through Catholicer, in which, the donation is treated as an undelivered donation.

UNWILLINGNESS TO AUTOMATE

If after one mail delivery, a recipient is still not registered to our platform to receive donations electronically. We may deliver the donations through other means with the same delivery cost. This may include recipient's online giving, their website, donor advised fund of our choice directed to the recipient, or other means. There may be an extra fee taken by a third party we choose that is not calculated to our delivery fee.

UNDELIVERED DONATION

In case of donations can't be made for any reasons in the best effort MercyWallet tries to make, such as but not limited to: relocation, or closure without notice, MercyWallet may refund the amount subtracted by payment processing fee MercyWallet uses (we promise to be honest but have no obligation to disclose a proof of the charge). In case of recipients not cooperating to signup for our integrated system, there could be delays before recipients clear the check MercyWallet sends. However, if the recipient has a website that accept online donation of user's donation amount, we might choose to make another attempt using their publicly announce donation method, which might reduce the final amount received on their end. Undelivered donations beyond 365 calendar days, will be returned to donors with terms above. Catholicer reserves the right to shift the distribution to similar organizations at its own discretion if necessary.

RECEIPT, END-OF-THE-YEAR SUMMARY, ACKNOWLEDGEMENT LETTER

Stripe will generate donor a receipt, that receipt is a proof of transaction between donor and Catholicer. It does not bind any contract or prove any donor-recipient relationship between a donor and a recipient. The receipt from stripe may only be used as a proof of transaction if permitted by law. Catholicer will email end of the year donation summary to donors.

RECIPIENT REGISTRATIONS

Recipients may be listed with or without prior notice or their consent. This is due to the nature of public non-profit information. Any recipient can be removed at any time by MercyWallet if deemed not being a good recipient or due to doctrinal reason in relation to the Roman Catholic Church.

PAYMENT GATEWAY OR DONATION GATEWAY/PLATFORM (THE "GATEWAY")

All payments occur in third parties used by MercyWallet. They all depend on the selection of each Recipient. MercyWallet only supports one donation gateway or payment gateway at a time for one organization. Catholicer is not responsible for educating, supporting, setting up, maintaining, updating anything from the gateway used. A recipient is responsible for keeping their Gateway account active, safe and manually altered unless approved or requested by MercyWallet team. All activities in your payment gateway should only occur due to activities generated by MercyWallet. At this moment, MercyWallet only supports Stripe Payment Gateway.

CONTRIBUTION TYPE / CAUSE

Both user and admin can add an existing donation cause, but alteration could be done by the admin only. By altering an existing cause's name, all existing donation receipts toward this cause will show a new cause name. It is against the law to reallocate existing restricted donation to another unrelated cause. Please check IRS website for more detail. Managers who made the change are responsible for any damages or errors made from this change, including to report to IRS and apologize to donors if anything occurs. Catholicer is providing this renaming tool to easily fix a typo or to alter an existing cause that had no previous donation yet.

MATCHING FUND

Any users in MercyWallet has the right without prior acknowledgment from receiving organizations to make a pledge that matches funds from other donors. All match-funds are mainly automated. Any pledge can be stopped and collected at any time. A claimed organization also has the right to stop any on-going pledges for any reasons, without prior notice to the pledger. Catholicer also has the right to interfere in any way for any reasons at our own discretion, for any reason. A user could get banned if we detect multiple failures to pay the total matched fund in full, whether the failure lies on their own mistake or financial institution that represents their account. If the total matched amount is bigger than zero but lower than our minimum donation requirement, which we are not obligated to disclose, we will charge the pledger the minimum amount. Pledgers and donors have the responsibility to make sure they are fully educated about the system before donating to a cause that has a pledge or setting a pledge toward the cause.

SWEEPSTAKES

MercyWallet simply provides a tool to randomly pick an audience live. Any sweepstakes conducted with this tool by anyone have no affiliation with Catholicer or Google or Apple unless stated otherwise. Hosting party has to make sure they are in compliance with any possible governmental regulation required. Participating user is to use it at their own risk. Catholicer is not responsible for any terms, errors, accidents, types, or possible outcomes of sweepstakes carried out using our technology.

POSTS

MercyWallet hosts a public message board/discussion board, which might be equipped with commenting facilities. While we invite you to share your opinions and questions in this way, they must not be used to distribute spam messages, post commercial advertisements, or spread links to malicious or dangerous websites. We do retain the right to moderate any comment or written content submitted to the MercyWallet and to remove any content we deem to have violated our policies.

FEE

Catholicer takes a fee on the platform. All updated fee will reflect on https://www.mercywallet.com and can change at any moment without prior notices to donors and recipients. Catholicer will send the remaining amount of donations after deducted with our platform fee. In case donation needs a refund for any reasons unless it is caused by Catholicer or its services, fees may not get refunded. The Recipient needs to refund the extra amount at their own cost & method. However, recipients in goodwill have the right to reject giving any refunds for any reason. Fees are applicable for both claimed and unclaimed recipients.

SPECIAL RATE

Each special rate depends on individual cases. MercyWallet exercises its freedom to deny any requests to get a special fee for any reason and without having to disclose the reason. The special rate might expire at any moment unless specified in a contract.

PERMISSION

You may not use, alter, or access any content, functionality, or other information that you are not given access to. You are not allowed to use any information found in MercyWallet for spam, scam, crime, or anything against the law of the State of California and against the Roman Catholic Doctrine.

RECIPIENT PROFILE

MercyWallet displays information from Catholicer Directory. Therefore terms and conditions for catholicer applies here. Due to the nature of public available data, recipients might alter information on their profile page. MercyWallet tries its best to record each 501(c)(3)'s EIN. In case of reincorporation or other major changes made by recipients, a claimed recipient is responsible to keep their profile updated on Catholicer and to send an updated proof of 501(c)(3) document to MercyWallet. Email admin@mercywallet.com to inform any changes.

TERMINATION

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the California, without regard to its conflict of law provisions.

Should any provision of this Agreement be held by a court or other tribunal of competent jurisdiction to be void, illegal, invalid, inoperative, or unenforceable, the remaining provisions of this Agreement shall not be affected and shall continue in effect, and the invalid provision shall be deemed modified to the least degree necessary to remedy such invalidity.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without any notice. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
